Summary

The advisor will work at the Ministry of Education, Culture and Higher Education (MOECHE) and under the direct supervision of the Officer of the Minister but will closely coordinate with the Office of the State Minister, Deputy Minister, Permanent Secretary, and Direct General of MOECHE. The Policy Development and Legal Advisor will assist the Ministry in legal related matters of education and support permanent secretary by developing subsector policies and reviewing the National education Act and National Education Policy. He will also act as a legal counselor and policy adviser to the Minister in all legal matters.
The Adviser will provide strategic advice to MOECHE on policy making and strengthening the capacity of the Ministry of Education in the promotion of education reforms committed by the Government Activity Program.

About MIDA FINNSOM Project
IOM Migration for Development in Africa (MIDA) programmes focus on strengthening the institutional capacities of African States through a structured framework of mobilization of resources involving countries of destination, countries of origin and diasporas. In Somalia, through its MIDA programme, IOM has been helping the Somali Government since 2008 to strengthen the capacity of Somali institutions so that they can be more effective in responding to the needs of Somali people. The MIDA FINNSOM South Central Somalia project is funded by the Government of Finland. Similarly, to the MIDA FINNSOM Health projects implemented in Somaliland and Puntland by IOM Helsinki with support from the Finnish Government, this project aims to facilitate the transfer of skills, competencies and knowledge of qualified Somali expatriates to public institutions in South Central Somalia, with focus on two sectors: health and education. The beneficiary institution will host the qualified Somali expatriate, and will be responsible to provide a safe and secure work environment. The IOM Mogadishu MIDA staff will monitor the expatriates while on assignment.

About Ministry of Education, Culture and Higher Education (MoECHE)
Somalia has been in a state of emergency as well as recovery for over two decades. Presently, the Somali Federal Government is grappling with a host of issues related to fragility, weak systems, and is still at the very early stages of state building. Although some minor gains in education can be noted over the past several years, the country faces numerous challenges with strengthening the capacities of education institutions and systems to support continued progress to achieving SDG 4 education targets, particularly those related to improving access to education and improving learning outcomes. There remain significant political and social risks with many communities affected by conflict, displacement, trauma, and high levels of poverty. The Policy Development and Legal Advisor develops policy and programs to support the primary objective of the Ministry of Education, Culture and Higher Education. The position will oversee the set of national and regional standards and guidelines for all assessments, evaluation and reporting of education activities across the country.

Expected Result

Besides day to day advice and on the job coaching, he/she will develop analytical products in the form of advisory notes, reviews, assessments leading to policy papers, as well as provide direct ad-hoc strategic advice as required by the target activities of MOECHE.

Under the overall guidance of the designated supervisor, the Legal Advisor will be responsible for the following duties and responsibilities:

1.Provide expert advice to the Minister of education and reviewing all the agreement between the other counter ministries on an on-demand basis
2.Strengthen the capacities of the ministry in policy development, strategy planning and policy implementation;
3.Provide information and advice on National Policies, including policies and legislation concerning the education sector;
4.Provide strategic advice and guidance to the Minister of Education in designing and implementing the education strategies and plans to communicate the implementation of Government Programs and donor activities;
5.Identify and present to strategic perspectives on emerging laws and legal issues as well as identifying and analysing legal issues as prioritized in government national plans (including the Compact).
6.Produce monthly report on key achievements.
7.Participate public consultation and parliamentary dialogue during the review of education act.
8. Participate and support drafting stage of key sub policies.
9.Provide mentoring and advise the key technical officers and coaching up to a level of competency to be able to competently perform policy implementation and education Act.
10.Provide guidance for the development of policy brief for the reformation and development of the education system in the context on Government Activity Program and the development of the strategic Education of the next decade.
11.Undertakes other assignments assigned by MoECHEs management.

Requirements

1. Transfer of skills: one of the main responsibilities of the qualified Somali expatriate, and one which he/she will be measured against, will be to insure continuous and systematic transfer of knowledge and skills are related to the assignment it will have to be agreed with the beneficiary institutions, which civil servants will have to benefit from this knowledge.
2. Work plan: A work plan will have to be developed with the supervisor at the line Ministry during the first week of assignment, which will provide clear and time bound activities to successfully implement the outputs of assignment.
3. Monthly and final reports: Monthly progress reports will be submitted by the incumbent to the Supervisor in the Ministry and to IOM Mogadishu MIDA Programme Officer. At the end of the assignment.

Qualifications

Level of Education:Masters Degree, preferably a PhD Degree
Area of Study:Law, Public Policy, Public Administration, Management, or other relevant areas
Years of work experience in what area(s):Preferably more than 15 years of professional experience in providing strategic advice and development of public development policies;
Languages needed:Somali and English,
General Skills / Other Requirements:Knowledge of the education sector, national and regional development framework;
Substantive overall understanding of development trends and ability to present related issues clearly both to a general and a specialist audience;
Outstanding drafting and communication skills;
Excellent analytical skills
Experience in providing consultation and advice to government body or other international development partners such as USAID, EU, etc.;
Experience in national and international negotiations;
Previous work experience in Somalia would be an advantage;
Fluency in Somali and English
Ability to interface effectively with a wide range of stakeholders.

Security

Health insurance, including evacuation due to medical emergency, will be provided by the project. However, experts will be requested to provide a recent medical certificate stating that they are physically well and apt to work in a hardship area in Africa.
Please note that neither IOM nor Swedish Government, according to the contract, will be responsible for the security of the qualified Somali expatriates. The host beneficiary institution will be responsible for the security of the individual.
Before leaving the country of residence and upon arrival in Nairobi or in Somalia, the qualified Somali expatriate will receive a pre-departure briefing including security advice and cultural background.
